Etsy is facing a class action lawsuit alleging that the company’s website is inaccessible to visually impaired and legally blind people, violating the Americans with Disabilities Act (ADA).
Lamar Brown, a visually impaired and legally blind person, visited Etsy’s website to purchase a necklace for Mother’s Day. Due to lack of accessibility measures on Etsy.com, Brown was unable to browse the website and complete her purchase, the complaint states.
Blind people have an even greater need than sighted people to shop and transact online due to mobility challenges,” the complaint argues. “Blind customers are essentially blocked from purchasing items on Etsy.com.”
Brown seeks to represent a national category and a New York State subcategory that includes all legally blind people who have attempted to access Etsy.com and been denied access to the enjoyment of property and services offered by Etsy.com, during the relevant legal period. .
Etsy Lacks Website Accessibility, Alleges Class Action
Blind and visually impaired people often use screen reader software to access the Internet. This software requires that information from a website can be rendered as text. Etsy’s class action lawsuit notes that the World Wide Web Consortium (the international organization for website standards), several courts and the federal government have issued standard guidelines for website accessibility.
Etsy denies people who are blind and visually impaired equal access to its website, goods and services in several ways, according to Brown. These include: lack of alt text (invisible code embedded in images) on graphics, inaccessible drop-down menus, lack of proper prompts and labeling, selective denial of keyboard access, and the requirement that transactions are carried out only with a mouse.
